Carolyn explains how a Chapter 7 bankruptcy filing immediately changes the trajectory of a case, noting that a bankruptcy stay under Section 362 of the U.S. Bankruptcy Code halts ongoing litigation and prevents further collection actions without court approval. “The stay halts the appointment of a receiver and instead brings the debtor’s assets under the jurisdiction of the bankruptcy court,” she said.
